Thank you for using Samsung Services.

Samsung Electronics Co., Ltd. (including its affiliates, hereinafter referred to as “we,” “our,” or “Samsung”) provides various features, apps, and services (“Services”) for your ease and convenience in using Samsung’s products. These Terms and Conditions contain important information necessary for using our Services.

ACCEPTING AND CHANGING OUR TERMS

By creating a Samsung account or downloading or using the Services, you confirm that you accept these Terms and Conditions. Please read these Terms and Conditions carefully before using Services. By accepting these Terms and Conditions, Samsung considers you to be:

1. Not a legal minor in your country of residence.

2. You are not a person who is legally authorized by a parent(s) or a legal representative and is not prohibited from using the Services by the law applicable to your country of residence.

Minors must obtain the consent of their parent or legal guardian to create and use a Samsung account. Some services may be restricted wholly or in part from registration or use by Minors.

Parents or legal guardians shall be deemed to have agreed to these terms and conditions by giving consent to their Minor creating and using a Samsung account and shall assume all responsibilities related to the use of the services by the Minor.

We may change these Terms and Conditions. We will let you know about any changes by posting the updated Terms on our website. If there is any information that may have a material impact on you, we will notify you in an appropriate manner including an email to the address linked to your Samsung account or a notification through individual Services. Changes will take effect on the date separately specified in the changed Terms and Conditions. If you do not agree to the changed Terms and Conditions, you may not be able to use the Services. Even if you do not agree to the changed Terms and Conditions, by continuing to use the Services after the effective date of the changed Terms and Conditions, you confirm that you accept the changed Terms and Conditions.

THINGS TO KNOW BEFORE USING OUR SERVICES

LICENSE | We grant you a license to freely use the Services. However, the license is limited, non-transferable, revocable, and non-exclusive. You may only use our Services only for non-commercial purposes in accordance with these Terms and Conditions and the instructions that we provide in our Services. All references to our Services include all related content and any other materials used to provide our Services, including updates, upgrades, enhancements, modifications, revisions, and additions to our Services that we make available to you. You are required to acknowledge and agree that we hold the rights to the Services and the rights are protected under applicable copyright, trademark, trade secret, patent, and other intellectual property laws and treaties. Even if you agree to these Terms and Conditions, they do not grant you any ownership interest in or to our Services, but only a right of use specified in these Terms and Conditions. In addition, we may change the contents or scope of the Services in accordance with its operational and technical needs, such as the country in which the Services are available, the devices being used, the types of the operating system (OS), and the internal policies of Samsung or its partners.

USER GUIDELINES | We work hard to protect the security and safety of all users who use the Services, and to ensure that users can freely use the Services. To that end, please be careful not to misuse the Services by:

1. Attempting to discover the source code or algorithms of our Services by means of software reverse engineering, etc.

2. Attempting to arbitrarily modify or disable any features of our Services

3. Creating any derivative works based on our Services

4. Renting, leasing, lending, sublicensing, or providing any hosting services using our Services

5. Infringing on our intellectual property rights or the rights of any third party while using our Services

6. Using our Services in any way or for any purpose that violates these Terms and Conditions or any applicable laws

7. Using our Services in any fraudulent or malicious way (e.g., hacking, or distributing malicious code or harmful data such as viruses);

8. Using our Services in a way that may interfere with other users, damage, overburden, or impair the system, or compromise the security of the system

9. Attempting to decipher any transmission between our Services and servers, or collect any data or information from the Services or systems

INTERNET | To use our Services, you may need to access the Internet. If you access the Internet through a mobile network, additional charges may apply depending on your payment plan. We are not responsible for the availability or speed of Internet access.

UPDATES | We are always working to make our Services better. To share improvements and new features with you, we provide updates or upgrades to our Services. These updates and upgrades are designed to improve, enhance, and further develop our Services and may include bug fixes, patches, enhanced features, plug-ins, and new versions. Please continue to update to the latest version for reliable use of our Services. Essential updates, such as critical bug fixes or security updates, may be downloaded and installed automatically without your consent to protect all users. For other updates, you will be notified in advance and be given an opportunity to download and install the update files.

THIRD PARTY SERVICES | We work with a global network of partners to provide you with useful content in our Services. Therefore, our Services may include content (information, links, advertisements, etc.), products, services, and other materials provided by third parties (“Third-Party Services”). You can enjoy a variety of benefits through Third-Party Services. However, we have no control over Third-Party services. Therefore, we are not responsible for any damage or loss caused by the use of any Third-Party Services.

ADVERTISEMENTS | We provide various Services for free. To that end, we may show advertisements in some Services. We may show advertisements or marketing-related information provided by us or third parties in the Services.

SAMSUNG ACCOUNT

A Samsung account may be required to use Samsung services. To sign up for a Samsung account, the following must be followed.

1. You are required to provide us with accurate and complete information when creating an account.

2. If there are any changes to your information, you are required to update your account information.

3. When using your account, please be careful not to leak your password or share it with others.

4. If you suspect that your account is being used without permission, you should notify us immediately.

You can delete your account and cancel your membership at anytime at the Samsung account website.

Child Account

A separate account policy shall apply to Samsung accounts (hereinafter “child account”) for children under the age of 14 (hereinafter “child”).

In order for a child to create a child account, the explicit consent of a parent or legal guardian must be obtained, and this parent’s or legal guardian’s Samsung account may be required to create a child account.

Parents or legal guardians have the right to manage the child account (this includes the right to modify the child account information and delete the account), and in relation to the creation of a child’s Samsung account and service use, they shall (i) agree to these Terms, (ii) supervise the child’s use of the services, (iii) assume all risks and liability associated with the Minor’s use of the services, and (iv) ensure the accuracy and truthfulness of all information submitted by the Minor.

USER CONTENT

LICENSE | Some Services allow you to share share content such as posts, photos, messages, and documents with other users. You are free to share your content as you own the intellectual property right to the shared content. However, you need to grant us a license to use your content in our Services. When you upload, transmit, create, post, or otherwise provide any information, materials, documents, media files or other content through our Services (“User Content”), you grant us a license to copy, edit, distribute, translate, publish, publicly perform and publicly display the User Content. The license includes worldwide royalty-free rights and authorities that may not be revoked by the user without any limitation in the use of the content.

CAUTIONS | We do our best to keep your content safe, but we are not responsible for any loss of your content or data. Please be sure to prevent the loss of your User Content and related data stored through our Services by making copies of the content and data or creating backups at another location using online backup and other services. Please note that the content and data cannot be restored if lost, and we are not responsible for the loss. In addition, with regard to the User Content, you represent and warrant that:

1. You are the owner of all rights pertaining to the User Content and otherwise authorized to grant as a license to use the User Content.

2. The User Content does not infringe on any intellectual property or others’ rights.

3. The user content complies with the age classification rules and requirements under the laws of the country where you are a resident or from where you are using our Services.

SERVICE CHANGE AND TERMINATION

CHANGE OF SERVICES BY US | We may change the Services at any time by:

1. Changing, adding, suspending, or removing specific services or features from our Services

2. Suspending or terminating your use of, or access to, our Services, including access to your account, data included in your account, or other content

3. Pre-screening, reviewing, flagging, filtering, modifying, rejecting, blocking access to, or removing content provided through our Services.

DISCONTINUATION BY USER | If you do not want to use any of our Services, you may discontinue the use of the Services at any time and delete your Samsung account or the individual Services.

TERMINATION BY US | Samsung may suspend or terminate your use of the Services at any time if:

1. You have violated these Terms and Conditions or the instructions that we provide in individual Services.

2. You have clearly demonstrated that you do not intend to comply with these Terms and Conditions.

3. We or a partner providing services to us decide to terminate all or a part of the Services.

4. We or a partner providing services are required by applicable law to terminate all or a part of our Services.

The discontinuation or termination of your use of the Services does not have any prejudice to any rights, obligations, and liabilities that you or we have accrued or incurred during the term of these Terms and Conditions.

NOTIFICATIONS | We will do our best to notify you of any change or discontinuation of the Services in advance, unless in case of emergency, in a reasonably available manner including an email to the address linked to your account or a notice in the Services To the maximum extent permitted by applicable law, we are not to you or to any third party as long as we provide such a notification.

WARRANTY AND RESPONSIBILITIES

SCOPE OF OUR WARRANTY | To the extent permitted by applicable law, our Services are provided ‘as-is’ or ‘as available’ without warranties of any kind. For example, we disclaim all specific terms and legal warranties of merchantability, satisfactory quality, workmanlike effort, fitness for a particular purpose, reliability, accuracy, lack of viruses, maintenance of a noise-free environment, non-infringement of third party rights or other rights. Some jurisdictions do not allow exclusions or limitations of implied warranties, so the above exclusions or limitations may not apply to you.

SCOPE OF OUR LIABILITY | We are not liable for any damage caused by the user’s use of the contents or features provided by our Services unless it is caused by our deliberate act or gross negligence. The scope of damage includes errors, omissions, shutdowns, defects, delays in operation or transmission, computer viruses, connection failures, and network costs that occurred without any special reasons, and includes all direct, indirect, special, incidental, punitive, and consequential damages resulting therefrom. However, some jurisdictions do not allow exclusions or limitations of damage, so the above exclusions or limitations may not apply to you.

GENERAL INFORMATION

PROTECTION POLICY FOR USERS’ INTELLECTUAL PROPERTY | We value the intellectual property rights of everyone including the users of our Services. In accordance with applicable law, we may verify suspicions of copyright infringement or other legal violations, and may terminate, suspend, or block access to the account of a user who repeatedly infringes on copyrights or violates applicable law.

GOVERNING LAW / DISPUTE RESOLUTION | These Terms and Conditions are governed by the laws of the Republic of Korea without giving effect to any conflict of laws provisions. If a dispute, argument, or disagreement in the course of your use of our Services is not resolved in an amicable manner, the matter is subject to the non-exclusive jurisdiction of the court with the jurisdiction over your place of residence. Nevertheless, we may seek forcible enforcement or preservative measures at local courts other than those with the jurisdiction over your place of residence.

ENTIRE AGREEMENT / SEVERABILITY | These Terms and Conditions constitute the entire agreement between you and us with respect to our Services, and supersede all prior oral and written agreements with respect to our Services or any subject matter covered by these Terms and Conditions. If any provision of these Terms is invalidated, revoked, or loses its effectiveness on account of being illegal or unenforceable, the remaining provisions of these Terms and Conditions will remain in full force and effect.

PROTECTION AND MAINTENANCE OF OUR RIGHTS | Except as expressly provided in these Terms and Conditions, we do not grant any patents, know-how, copyrights, trade secrets, trademarks, or other intellectual property rights owned or controlled by us, including the right to use our name, trade dress, logos, or their substitues. Even if we do not exercise or enforce any legal rights or remedies which are set out in these Terms and Conditions or which we have the benefit of under applicable law, this will not be construed as a formal waiver of our rights ore remedies an official waiver of such rights or remedies and such rights or remedies will remain available to us.

OUR RIGHT TO USER FEEDBACK | If you choose to make available any ideas, suggestions, or feedback including those about new products, technologies, promotions, product names, product feedback, and improvements, you grant us the right to create and generate derivative works regardless for any purposes using any methods, and use, share, and commercialize your feedback without a fee or any other obligations.

EXPORT RESTRICTIONS | Export restrictions may apply to our Services in some countries, and you are required to comply with all laws applicable to our Services, including all applicable export restriction laws and regulations.

LANGUAGE | We may provide you with a translated version of these Terms and Conditions for easier understanding. If the translated version conflicts with the Korean version, the Korean version prevails over the translated version.

SPECIAL SERVICE TERMS

These Terms and Conditions generally apply to all of our Services. However, the terms in the following paragraphs serve as special terms that apply to the specified Services, and take precedence over the general Terms and Conditions above. In addition, for other Services, we may additionally provide separate terms, policies, instructions, guidance, and notifications. Please read them carefully before using the individual Services.

Samsung Cloud | In the event that you are not separately notified within the service about the retention period, if you do not use all or a specific content category of Samsung Cloud Services for more than twelve (12) months, to protect personal information and secure service resources, we will delete the User Content and information stored on Samsung Cloud or in the specific content category beyond recovery by giving a thirty day (30-day) notice in advance. (However, this does not apply to paid service users.) In addition, if you do not back up any content of your device to Samsung Cloud for more than a year, Samsung reserves the right to delete the backup associated with that device, and will notify you of the expiration date of the backup storage period in an appropriate manner. When temporarily backing up data using Samsung Cloud’s temporary backup service (name of service may change from time to time), restoration is possible only within the retention period, about which you’ve been notified, at the time of backup, and data may be deleted once the retention period has passed. You are responsible for storing your content or backups, etc. at a separate location before they are destroyed or deleted. Samsung is not liable for any loss arising in this regard unless there is negligence on Samsung’s part.

Samsung Health | Samsung Health Services may not be used for medical use including diagnosis, treatment, mitigation, and prevention of diseases. of medical purposes such as diagnosis, treatment, relief, or prevention of your diseases. If any abnormality occurs in your health or body during use, you should stop using Samsung Health and consult a doctor or other professional. As the contents or information provided by Samsung Health is based on standard data or the subjective information provided by you or objectively measured information, it does not accurately reflect your physical characteristics or specific health status, or the environment in which you exercise.

Samsung Pass | In the course of using Samsung Pass, you are required to provide or update your accurate personal information and keep it secure. In addition, you are not allowed to lend or transfer the right to use your Samsung Pass or grant access to others, or steal or use another person’s biometric or personal information without permission.

Samsung Find & Samsung SmartThings | Certain products or third-party devices, content, services, and products, etc. (hereafter referred to as “Products”) may not work or may cease to work with Samsung Find and SmartThings despite supporting the same standards. Samsung does not provide any guarantee or warranty of compatibility for third-party products, even if such third-party products are accessible through Samsung Find and SmartThings. Please note that if you add members, such members will have full access and control over any and all of your products that are synced to Samsung Find and SmartThings.

If a tag product is detected to have been tagged to another person for a period of time without a connection to the user’s mobile phone, then measures may be provided to help locate the tag.

If you change the registered country of your Samsung account, your account will be withdrawn from Samsung Find and SmartThings and your data will be initialized. In this case, you can sign up based on the changed country to use Samsung Find and SmartThings.

Samsung Find should not be used to track the location of another without the person’s knowledge or consent. If you track the location of another with Samsung Find, the person will be notified of the fact that you track the location information. The person can block you from sharing the location information, but a parental consent is required to block the parent from sharing location information of the minor child.

Samsung Digital Key | Samsung Digital Key allows you to issue keys for compatible products, delete the issued keys, and share the keys with others. If you share a key with others, they will have access to and control over the product. Please be careful when sharing a key with others. In addition, you are not allowed to access someone else’s key in unauthorized ways or use the key without permission. You are responsible for keeping your device and account secure so that your authorized keys and related information are not lost or leaked. Samsung is not liable for any losses arising in this regard unless there is negligence on Samsung’s part.

Samsung Internet | This service is licensed under the AVC portfolio license for the personal and non-commercial use of a consumer to (i) encode video in compliance with the AVC standard (“AVC Video”) and/or (ii) decode AVC video that was encoded by a consumer engaged in a personal and non-commercial activity and/or was obtained from a video partner licensed to provide AVC video. No license is granted for any other purposes, and such intention is not implied. Additional information is available at MPEG LA, L.L.C. Please refer to the HTTP://WWW.MPEGLA.COM page.

Advanced intelligence | “Advanced intelligence” refers to a service that helps increase productivity by utilizing artificial intelligence to summarize and edit an article, translate languages, and draft various kinds of creative content. Features of “advanced intelligence” can be found in the service list below (subject to change at any time). To clearly stipulate, “advanced intelligence” does not include intelligence functions or services provided directly by third parties to users, and separate Terms and Conditions provided by third parties to users applies to these third-party services.

A. Call assist (phone)

– Translates a real-time conversation during a phone call.

B. Chatting assist (Samsung Keyboard, notification, Watch notification)

– Translates conversations in the message app, types in short sentences or requests to write what you want, changes the sentence styles, and shows suggestions for correcting spelling and grammatical errors.

– You can get a recommended reply that goes well along with the conversation. (only available for the models that support the feature)

C. Photo assist (Photo Editor, Contacts)

– Moves or deletes a person or object in an image, converts a portrait into various styles, or reconstructs an image by drawing an object.

D. Interpreter

– Translates a verbal conversation or lecture into voice or text in real time.

E. Note assist (Samsung Notes)

– Organizes the format of a note provided as text or handwriting automatically, and edits the note so that it appears neat by making a summary, checking spelling, and translating. Also, converts and summarizes voices into text, and makes the note appear neat with covers and images created by AI.

F. Text conversion assist (voice recording)

– Converts recorded voice into text and summarizes and translates it.

G. Browsing assist (Samsung Internet)

– Translates texts in an web page and summarizes it.

H. Weather and time (wallpaper and style)

– Shows a different background screen depending on the time and weather.

I. Drawing assist (Air Command, Smart Select, Photo Editor, Samsung Notes, Edge panel)

– Transforms a simple painting into a wonderful art work and naturally adds new elements to existing images.

J. Bixby

– Ask Bixby if you have any questions about using devices or if you need help troubleshooting it.

K. Health assist (Samsung Health)

– Analyzes your energy score to provide helpful information for your health.

Users input texts, photos, images, and more (hereinafter “Input”) to use “advanced intelligence” and “advanced intelligence” returns a result or content (hereinafter, “Output”) based on the input information.

By using “advanced intelligence,” you confirm that you accept these Terms and Conditions. Please read these Terms and Conditions carefully before using Services.

1. “Advanced intelligence” may offer the following “Output” to users.

1.1 Inappropriate or disturbing “Output” that do not represent Samsung’s stance or opinion

1.2 Same or similar “Output”

2. “Advanced intelligence” may offer incomplete, incorrect, or unreliable “Output” to users.

3. Do not use “advanced intelligence” for a wrongful purpose or in a way that may be in violation of Terms and Conditions or legal regulations. Also, please be mindful that the following behaviors are not allowed in using “advanced intelligence.” In addition to the below restrictions, additional policy, regulation, guideline, and notice may apply in using “advanced intelligence” and those can be found in a separate policy page, or etc.

3.1 An act that may inactivate, impair, interfere, or bypass some or all functions of “advanced intelligence” or an act that may damage other services

3.2 An act of transmission or distribution of the followings: malware, viruses, Trojan horses, corrupted files, destructive code, and something that may harm or interfere with the operation of networks, servers, or infrastructure of Samsung or third parties

3.3 An act of connecting or accessing, obstructing, or damaging a part of the “advanced intelligence” or “advanced intelligence” without permission or beyond the permission granted

3.4 For paid services, an act to bypass bill charges, including the act of disguising as a single customer application, account or project or the act of creating multiple customers, accounts or projects that are operating, or an act to circumvent usage limits or quotas for each service

3.5 An act of creating or transmitting spam, mass messages, emails, promotions, advertisements, automated messages or calls, etc.

3.6 An act of attempting reverse engineering, decompiling, or extraction of some or all of the source code of “advanced intelligence” (except where relevant laws explicitly prohibit restrictions on such acts)

3.7 An act of copying, editing, or creating a secondary work of “advanced intelligence’

3.8 An act of selling, reselling, license reselling, transferring, or distributing some or all of “advanced intelligence”

3.9 An act of using “advanced intelligence” for antisocial or illegal purposes (including, but not limited to, sexual exploitation, child abuse, terrorism or violent activities, and other activities that can be reasonably expected to result in the death or injury of an individual or group) or an act of inducing or encouraging such use

3.10 An act of using “advanced intelligence” for illegal, infringing, or fraudulent purposes (including, but not limited to, infringement of other people’s intellectual property rights, unconsented exotic images, phishing, pyramid schemes, etc.) or an act of inducing or encouraging such use

3.11 An act of using “advanced intelligence” for medical, legal, financial or other professional advice (all “Output” related to these topics are for simple information-offering purposes only and cannot replace the advice of qualified experts)

3.12 An act of engaging in activities that can be reasonably expected to cause death, injury, environmental pollution, property damage, etc. of an individual or group by using “advanced intelligence” or failure of it

3.13 An act that includes creating, distributing a false, inaccurate, misperceiving, or misleading content, including the followings.

3.13.1 An act of falsely stating or displaying the source of the “Output,” such as claiming that the “Output” created by “advanced intelligence” are human-created content or labeling them as original works

3.13.2 An act that includes creating, distributing the “Output” by disguising or labeling them as if they are from a third party including a person (regardless of actual existence), an institution, a corporation, etc.

3.13.3 An act that includes creating, distributing content, arguments, and more that may cause confusion about expertise or competence in controversial areas, such as health, finance, government services/policy, law, etc.

3.13.4 An act that includes creating, distributing “Output” that may induce wrong or biased advice or decision-making in areas affecting individual rights, well-being, and other important matters (e.g., finance, law, employment, medical care, housing, insurance, social welfare)

3.14 An act of using “advanced intelligence” to develop a machine learning model or related technology

3.15 An act of using “advanced intelligence” to violate the rights of another or an act of inducing or encouraging such use

4. You are solely responsible for responding to third-party claims regarding the use of “advanced intelligence” (including, but not limited to, copyright infringement or other claims related to the use of “advanced intelligence’), unless it is caused by Samsung’s intentional or gross negligence.

5. “Input” can be sent to the servers of Samsung or consignees for processing to offer some functions of “advanced intelligence”. On-device functions of “advanced intelligence” is available without sending “Input” to the server. Some functions of “advanced intelligence” support both the mode of using Samsung’s or consignee’s server and the on-device mode. The accuracy or quality of the “Output” may be degraded when using the on-device functions, so you must change the settings to enable the on-device mode to use “advanced intelligence” without sending “Input” to the server.

6. Some services of “advanced intelligence” may become available as paid services in the future.

Service-Specific Terms | The services below are subject to the Terms and Conditions for each service, and the unique policies, guidelines, information, notices, etc. set by each service may apply along with these Terms and Conditions.
